Judge declares mistrial in Lindsay Clancy case after jurors can’t reach a verdict

A Massachusetts judge declared a mistrial on Friday in the case of Lindsay Clancy, the former nurse accused of murdering her three children, after jurors deadlocked and were unable to reach a verdict.
The jury deliberated for about 38 hours over seven days. Jury notes indicated the 12-person jury, made up of nine women and three men, was split 11 to 1, but any verdict must be unanimous.
A mistrial ends the trial without a clear resolution and leaves open the possibility of a retrial with a different jury.
After Judge William Sullivan first said he intended to declare a mistrial due to a hung jury, defense attorney Kevin Reddington asked for time to file an emergency appeal to the Supreme Judicial Court.
The Massachusetts Supreme Judicial Court held a hearing in response to the emergency appeal by Reddington.
The Supreme Judicial Court ultimately denied Clancy’s emergency filing, Sullivan said in court.
After weeks of testimony and days of deliberation, Sullivan thanked members of the jury for their service after he declared a mistrial.
“Each one of you knew how long the case was going to go. You knew how difficult the case was going to be to listen to facts-wise, but still, you braced for that duty,” the judge told jurors.
Sullivan said he understood “how hard everybody worked in this case,” even though they were unable to come to a unanimous verdict.
“I understood that you all gave everything you could, and probably more than you thought you could, and so, on behalf myself, I just want to thank you so much,” he said.
