Former King City officer sentenced for holding ex-girlfriend at gunpoint

Friday a Monterey County judge sentenced former King City Police officer Jose David Hernandez to 90 days in jail for brandishing a firearm.

The 33-year-old investigator who had already been let go by the Police Department, was sentenced to 90 days in jail.

The Judge also denied Hernandez’s motion for a new trial and sentenced him to three years of informal probation. Hernandez was also ordered to surrender all firearms within 24 hours, and isn’t allowed to own or have any firearms or ammunition for 10 years.

In October 2014, prosecutors say Hernandez overheard his ex-girlfriend, from whom he rented a separate bedroom in a house she was leasing, being intimate with another man.

Investigators say Hernandez told them he just “couldn’t take it anymore,” and armed himself with a loaded gun before pushing the bedroom door open.

Hernandez remained in the bedroom and argued with the couple for
approximately 15 minutes, with the firearm still in his hand.

Prosecutors say Hernandez refused at least 10 separate requests by the woman to leave the bedroom.

The Monterey County DA’s Office says Hernandez called a commanding officer in tears and reported the incident and then made a series of incriminating statements to a sergeant from the Monterey County Sheriff’s Office, who investigated the crime and ultimately arrested Hernandez.

Hernandez is eligible to serve his jail sentence in the home confinement program. He was ordered to show proof of enrollment in the program or surrender to the Monterey County Jail on July 31, 2015.

Hernandez is no longer an employee for the City of King.
