UPDATE: Marina police searching for missing 5-year-old boy

UPDATE 2/5/15 9:47 a.m.: Marina Police said the missing 5-year-old boy was reportedly picked up by his aunt, Nellie Pena, who usually takes him to and from school. They believe she may have handed him off to his biological mother, Patricia Pena, who does not have custody of him but his father does.

Police said Nellie usually drives a dark blue 2009 Honda Accord, license plate 6JVY970. They said the two women don’t have a permanent residence and may be staying in a hotel in Monterey, Salinas, Greenfield or King City.

Police said right now there has been no Amber Alert issued because the child doesn’t appear to be in danger.

“The situation we have here is that the mother just simply refuses to bring the child back. Dad has sole custody,” said Marina police commander Bob Nolan.

Police also said the mother and father are in contact with each other. If you have any information on this case, you are asked to call police.
