Lawyers for Rep. Max Miller again subpoena Sen. Bernie Moreno, father of ex-wife

(CNN) — Lawyers for embattled Republican Rep. Max Miller have subpoenaed his former father-in-law Sen. Bernie Moreno as part of the ongoing custody battle between Miller and his ex -wife Emily Moreno, a source familiar with the matter confirmed to CNN.
It is the second time that Miller’s lawyers have issued a subpoena to Sen. Moreno and his wife.
Representatives for Miller and Moreno both declined to comment. TMZ was first to report on the subpoenas.
It comes as Miller is locked in a bitter fight for re-election in Ohio’s 7th congressional district and after Moreno called for Miller to exit the race earlier this summer.
Miller’s bid for reelection is one of several critical midterm races that could determine the balance of power in Congress.
The subpoena is part of the custody fight that has been ongoing between Miller and his ex-wife. During those proceedings, Emily Moreno had made serious allegations of abuse against Miller, allegations Miller has denied.
Miller is also being investigated by the House Ethics Committee, which Miller requested himself in August. There is no expectation the committee would release any findings before the midterms, however, as is customary in the months immediately proceeding an election.
